Interrogatories:

Interrogatories to be ministred to Roberte H[elme] ......... Anthonye Anderson two of the defendts at the suite of Cuthberte Bates Complaynante

1. Imprimis whether do you knowe one Thomas Bates late of Moorepethe in the countye of Northumberlande deceased [and] Isabell his wife and what dayes and yeare & where dyed the said Thomas Bates and Isabell, And whether do you knowe Marke Errington Willm Fenwicke George Graye and one Symon Chambers three other of the defendts [in] this Cause and howe longe tyme have you knowne everye of them ~/

2. Item whether was the saide Thomas Bates at the tyme of his deathe seised of the Capitall Messuage or fer[me] called Litle Bempton als Benton and of & in div[er]s landes meadowes and pastures w[i]th thapp[urtenances] in litle Bempt[on] als Benton aforesaide and of the advowson donacon and right of p[at]ronage of the Rectorye and p[ar]ishe Churche [of] Whalton in the said Countye of Northumberlande And of what estate dyed the saide Thomas Bates seised possessed of in the p[re]misses to your knowledge/

3. Item to what p[er]son and p[er]sons did the said Capitall messuage landes and ten[ementes] and the said advowson and right of P[at]ronage discende remaine and come Imediatelye after the deathe of the saide Thomas Bates in possession rem[ainder] and rev[er]con And by what tytle meanes conveghannces and estates did the same so discende remaine & come and howe knowe you the same./~

4. Item whether did Robte Bates brother and heire of the said Thomas Bates after the deathes of the said Thomas Bates and Isabell his wyfe claime the inheritance and possession of the saide Messuage Landes [and] ten[ementes] and whether doe you knowe and thinke that the saide Robte Bates might lawfullie have entered into [all] and singuler the said Landes and ten[ementes] and have occupyed and enioyed the same imediatelye after the deathes of the saide Thomas Bates and Isabell and eyther of them.~/

5. Item what matters causes and Impedim[en]t doe you knowe wherfore the said Robte Bates did not or might [not] lawfullie enter into the said messuage landes and ten[ementes] and at all tymes then after enioy the same And howe knowe ye the same .//

6. Item whether doe you knowe or were you made privie in the lyfe tyme of the said Thomas Bates deceased that he the saide Thomas Bates did make seale and deliv[er] anye granntes conveighannces, or estates of all or anye of the saide messuage landes ten[ementes] and advowson, And when where to whome, of how muche of the p[re]misses and for what terme did the said Thomas Bates make anye suche granntes conveighannces or estates who were all that were wittnesses thereof And howe knowe ye the same ~//

7. Item whether did the p[ar]ishe Churche of Whalton aforesaide become voyde of an Incumbent sithence the deathe of the saide Thomas Bates and what p[er]son or p[er]sons had the Right of P[at]ronage to the same Churche for the same avoydance, And by what tytle to your knowledge and as you thinke //~

8. Item what p[er]son and p[er]sons did p[re]sent to the said Churche beinge voyde of an Incumbent after the deathe of the said Thomas Bates And whether doe you knowe and thinke that the same p[er]son and p[er]sons had iuste lawfull and trew tytle then to p[re]sent to the saide Churche And howe knowe ye the same ~/

9. Item whether hadd the said Robte Bates right & tytle to p[re]sent a Clarke to the said Churche beinge voyde after the deathe of the said Thomas Bates and what cause doe you knowe wherefore he shoulde not or might not then lawfullye p[re]sent there unto././

10. Item whether ys the said Robte Bates nowe deceased And whether is the said Cuthbert Bates the nowe Compleyn[a]nte sonne and heire of the saide Robte and whether was the said Robte brother and heire of the said Thomas Bates ././

11. Item what doe you knowe wherefore the saide Compleyn[a]nte dothe not or maye not lawfullye enter and occupie the saide Messuage landes and ten[ementes] ~./

12. Item whether doe you knowe that there hathe binn anye suite sithence the deathe of the said Thomas Bates [in] the Queenes Ma[jesties] Courte of Channcerye at West[minster] betweene the saide Willm Fenwicke therein then Compleyn[a]nte and the saide George Graye then defendt concerninge the said advowson or anye the Landes & ten[ementes] of the said Thomas Bates And for what matters was the same And whether was the same suite comenced and prosecuted by the mutuall pryvitie & assents of the saide Willm Fenwicke George Greye and Marke Erington and at whose Charges was the same suite prosecuted and when and by whome were you firste made privie to the same suite ~./

13. Item whether have you seene the seale of Armes of the said Thomas Bates sythence his decease and what p[er]son and p[er]sons had the same and by what meanes come they and everye of them to yt /~/

14. Item whether had you at anye tyme sythence the deathe of the saide Thomas Bates anye speeches conference and agre[ement] w[i]th anye p[er]son or p[er]sons for & about the devisinge contryvinge and makinge anye lease leases or other estates in the name of the saide Thomas Bates deceased of the saide Messuage landes tenem[en]tes and advowson or anye p[ar]te there of and when where w[i]th whome, and to what effecte ende and purpose was the same .~/

15. Item what p[er]son and p[er]sons did enter into the saide messuage landes and tenem[en]tes and have receyved the rentes issues and p[ro]fits thereof sithence the deathe of the saide Thomas Bates, and of what yearlye value were the same and by what tytle and color of tytle did they and everye of them enter and receyve the same And what p[er]son and p[er]sons were previe and consentinge to suche their entrie and receipte/~/

16. Item what p[er]son and p[er]sons did wryte the two severall deedes shewed unto you at the tyme of this your examinacon, and eyther of them and whether were the same deedes and eyther of them written after the deathe of the saide Thomas Bates and when and where were the same so written .~.//

17. Item whether did the saide Marke Errington Willm Fenwicke and George Graye procure the saide sev[er]all deedes and eyther of them to be soe devysed and written, and whether weere the saide Marke Errington, Willm Fenwicke privie and did assent to the makinge and wrytinge of the saide sev[er]all deedes and eyther of them And what other p[er]son and p[er]sons were privie and did assent to the devisinge makinge & wrytinge of the saide severall deedes and wrytinges ./~

18. Item whether did the saide Marke Errington sett a seale to one of the saide Deedes or wrytinges shewed unto you at the tyme of this your examinacon that ys to saie to that deed w[hi]ch was written by George Graye and conteyne[d] onlye a supposed grannte of the advowson and p[at]ronage of the saide p[ar]ishe churche of Whalton, and whether was the same seale the seale of Armes of the saide Thomas Bates, Or what seale was set to the same laste recyted deede, and when where and by whome was the same wrytinge so sealed and whether w[ere] the saide Willm Fenwicke and George Graye privie and did assent to the saide Sealinge of the saide deede And what p[er]son and p[er]sons were privie to the sealinge of the said deede/~./

19. Item what p[er]son or p[er]sons did subscribe the name of the saide Thomas Bates to the saide wrytinge w[hi]ch conteyneth the supposed grannte of ................................................................................... ...................................................................... there unto, And when where and by whome was the same done ~./

20. Item what p[er]son and p[er]sons did write in thindorsem[en]t & on the backsyde of the saide sev[er]all dedes and wrytinges theis names that ys to saye Thomas Franke, Symon Chambers Robte Helme and Anthonye Anderson as supposed witnesses of the same deedes or wrytinges And howe manye, and w[hi]ch of the saide Thomas Franke Symon Chambers Robte Helme and Anthonye Anderson were then p[re]sente at the wrytinge of their said names of the backsyde of the saide severall deedes and eyther of them./ And when where in what manner, and by whome was the same And what p[er]son and p[er]sons were pryvie and did assent there unto ././

21. Item what p[er]son and p[er]sons did move and p[er]swade you to wryte into p[ar]chm[en]t the one of the saide deedes or wrytinges w[hi]ch conteynethe a supposed grannte of the saide messuage & landes in Little Bempton and the advowson of the said Churche of Whalton and by whose p[er]swasion and procurem[en]t did you wryte and Ingrosse the same wrytinge nowe shewed unto you, and when and where was the same soe doone And what p[er]son and p[er]sons were privie and did assent there unto./././

22. Item whether did the saide Willm Fenwicke sett his seale and subscribe his name to the saide deede or ... written by you and shewed unto you at the tyme of this your examinacon and when and where was the same done And whether were the saide other defendts privie and did assent there unto and w[hi]ch and howe manye of them were privie and did soe assent./~

23. Item what p[er]son and p[er]sons did write on the backside of the saide laste writinge written by you theis woordes signed sealed and deliv[er]ed in the p[re]sence of: And what p[er]son and p[er]sons did write underneathe the same woordes on the said backsyde of the said writinge Thomas Franke, Symon Chambers Robte Helme and Anthonie Anderson as supposed wittnesses to the same writinge And what p[er]son and p[er]sons were all that were privie and did consent there unto and when and where was the same done ././~

24. Item whether did you and the said Willm Fenwicke Marke Errington and George Graye publishe mainteine and Justifie and give in evidence the said sev[er]all deedes and wrytinges and eyther of them to be good and trewe, and when, where, to whome and in what manner was the same and what p[er]son and p[er]sons were pryvie and did consent there unto./

25. Item whether did you or the saide Marke Errington Willm Fenwicke and George Graye sett the seale of Armes of the saide Thomas Bates to the other p[ar]te of the wrytinge or Indenture written by you and shewed unto you at the tyme of this your examinacon and subscribe the name of the said Thomas Bates to the same other p[ar]te of the same Indenture./ And when where by whome and w[i]th what seale was the same other p[ar]te of the saide laste recyted indenture or wrytinge sealed & the name of the saide Thomas Bates there unto subscribed, And what p[er]son and p[er]sons were privie and did consent there unto././

26. Item whether did the saide Willm Fenwicke sithence the deathe of the saide Thomas Bates enter into the saide Messuage landes and ten[ementes] in Little Bempton by color of the saide deede or wrytinge written by you, Or by what other Tytle or conveighannce did he enter and take the profittes of the p[re]misses, And when did he soe enter, howe longe tyme hathe he taken the same profittes and to what value. And whether were you and the said Other defendts privie and did assent there unto ././

27. Item what some of moneye and other rewarde and consideracon had you geven or p[ro]missed for wrytinge the said deede or writinge conteyninge the saide landes & advowson and whoe had and hathe the other p[ar]te of the same deede and what and by whome, when and where was so geven or promised you~././

28. Item did the said Willm Fenwicke sithence the deathe of the said Thomas Bates clame the advowson and P[at]ronage of the said Churche and did p[re]sent his Clarke thereunto being voyde of an Incumbent and whether did he so claime and p[re]sent to the saide Churche by the saide sev[er]all deedes or by w[hi]ch of them or by what other tytle or color of tytle did he Claime the saide advowson or present to the saide Church And whether did he shewe forth the saide severall dedes at the tyme of his clame of the said advowson & right of P[at]ronage And when where to whome in what manner did he the same And whether were you and the saide other defendts & w[hi]ch and howe manye then were previe and did assent there unto././

29. Item what speeches conferences and agreem[en]ts hathe binn betweene you and the saide other defendt and betweene you and the saide Marke Errington Willm Fenwicke and George Graye and betweene you and anye other p[er]son and p[er]sons for and about the provinge of the said sev[er]all deedes and eyther of them and for and about the procureinge of the said Symon Chambers and Anthonye Anderson and anye other p[er]son and p[er]sons to be wittnesses and to make proofe of the saide sev[er]all deedes or eyther of them, And when where and w[i]th whome was the same And what p[er]son and p[er]sons were privie and did assent there unto./~

30. Item whether were you privie and did assent to the writinge deliv[er]ie and receyvinge of anye letters made and sent by the saide Marke Errington, Willm Fenwicke George Graye and Robte Helme to the said Symon Chambers and Anthonye Anderson to be examined in the Court of Channcery for the proofe of the said sev[er]all wrytinges indented or eyther of them And what were the contents of the same letters, who wrote conveighed & deliv[er]ed the same letters, and when by whome and to whome were the same sent & deliv[er]ed././

31. Item whether were the saide Symon Chambers and Anthonye Anderson produced sworne examined in the said court of Channcerye on the behalfe of the saide Willm Fenwicke againste the saide George Graye concerninge the saide wrytinges or eyther of them and when, by whome, on whose behalfe, at whose Charges and to what purpose were they produced sworne and examined in the said Court of Channcerye././ And whether ar you the same Anthony Anderson that was so p[ro]duced sworne & examined in the saide cawse & court in chancery

32. Item whether did the said Marke Errington, Willm Fenwicke and George Graye assent to produce sweere and examin the saide Symon Chambers and Anthonye Anderson in the said Courte of Channcerye in the said Cawse And when and what meanes did they and everye of them use therein/ And what other p[er]son and p[er]sons were privie and did consent there unto././

33. Item whether have you seene the deposicons and copies of the deposicons of the said Symon Chambers And Anthonye Anderson taken in the said Court of Channcerye aforesaid betweene the said p[ar]ties concerninge the said wrytinges or eyther of them. And what ys theffecte thereof./

34. Item whether are the Copies of the deposicons shewed unto you at the tyme of theis your examinacons the true coppies of the deposicons of the saide Symon Chambers And Anthonye Anderson taken in the saide Cause in the said Court of Channcerye betweene the saide Willm Fenwicke and George Graye And w[hi]ch p[ar]te of the same deposicons are true, And w[hi]ch p[ar]te thereof are untrue And howe knowe you the saide to be soe.//

35. Item what some and somes of money and other guiftes, rewardes and consideracons were geven bestowed & promised to you to be A witnes to depose in the saide Courte of Channcerye in the said Cause betweene the saide Willm Fenwicke and George Graye And when where and of whome & in what manner had you the same And what other matter or meanes did move & p[er]swade you to be a Wittnes & to depose in the saide cause in Channcerye And what other p[er]son and p[er]sons were privie and did assent there unto ~./

36. Item whether were you p[re]sent at the sealinge & deliv[er]ie of any Indenture of lease betweene the saide Thomas Bates of thone p[ar]tie and the saide Willm Fenwicke of thother p[ar]tie conteyning A demise of A certain messuage or ten[emente] called Little Bempton, and of the advowson and free disposicon of the p[ar]sonage of Whalton in the saide countye of Northumberlande and p[re]sent w[i]th the saide Thomas Bates lyeinge sicke in his bedd at the signe of the whyte horse in Islington in the Countye of Midd And wherefore did you depose the same in the saide Cause and Court of Channcerye./

37. Item whether doe you knowe that the saide severall deedes and wrytinges shewed unto you at the tyme of this your examincon and the counterpaines and other p[ar]tes of the same wrytinges and Indentures are untrewe and howe knowe ye the same

38. Item what other matter and thinge doe you knowe touchinge and concerninge the makinge, wrytinge, sealinge subscribing indorseinge publishinge and provinge the said sev[er]all wrytinges and eyther of them by you and the saide Marke Errington Wm Fenwicke and George Graye and every of you and them, And what ys your full knowledge aswell touchinge and concerninge the said supposed wrytinges and Indentures as also conc[er]ning the said examincons of the saide Symon Chambers and Anthonye Anderson./

39. Item where dwellethe the saide Symon Chambers and where and w[i]th whome hathe he dwelt sithence your firste acquaintance w[i]th him, of what profession, reputacon qualitie and condicon is the saide Symon Chambers and hathe binn for the moste p[ar]te duringe the said tyme./~


Depositions of Robert Hellme

Ex Cap. tertio die Decembr Anno RRne Eliz &c xxxvij Sup Interr ex p[ar]te Cuthbti Bates quer ministrate.

Robte Hellme of Tynemouth w[i]thin the County of Northumberland gent sworne saieth

To the first Interr[ogatory] This deft saieth That he dyd knowe one Tho Bates late of Morpeth in the County of Northumberland deceased & Isabell his wief And this deft sayth that the s[ai]d Tho Bates dyed at Prudhom Castle upp[on] the last daye of August in the xxixth yeere of the Queenes Ma[jesties] raigne that nowe is & that Isabell the wyef of the s[ai]d Tho Bates dyed likewise at Prudhome Castle in Maye in the xxxth yeere of her Ma[jesties] raigne And further this deft saieth That he doth knowe one Marke Errington Wm Fenwyck & George Graye three uther of the defts in this cause & dyd likewise knowe Symon Chambers one other of the defts deceased And this deft sayth that he hath knowne the s[ai]d Marke Errington Wm Fenwycke & George Graye for the space of xxth yeeres or thereaboutes And dyd knowe Sy[mon] Chambers for the space of tenne yeeres before he dyed or thereaboutes

To the second Interr this deft saieth That the said Thos Bates was at the tyme of his death seased of the Capitall Messuage or Farme called Lyttle Bempton als Benton & of & in dyvers landes meadowes & pastures w[i]th the app[ertenances] in Lyttle Bempton als Benton aforesaid & of the advowson donacon & right of patronage of the rectory & p[ar]sonage Churche of Whalton in the said County of Northumberland and saith that the s[ai]d Tho Bates was as he thinketh seised of & in the moyty of the s[ai]d Capitall messuage & landes therunto belonging late the landes of the L[ord] Marques of Northampton & of & in the advowson donacon & right of p[at]ronage of the rectory & p[ar]ishe Church of Whalton in his demesne as of freehold & of the other moyty of the s[ai]d Capitall messuage & landes being late the landes of Gregory Fynes L[ord] Dacres of the South the s[ai]d Tho Bates was seised to him & his heires for ever And the s[ai]d Tho Bates dyed of the said premisses so seysed as aforesaid

To the third Interr this deft saith that the s[ai]d Capitall messuage landes and ten[ementes] & the s[ai]d advowson & right of p[at]ronage dyd after the deathes of the s[ai]d Tho Bates & Isabell his wyef Come or of right ought to Come unto Robte Bates brother & heire of the s[ai]d Thos Bates and further to this Interr he sayth as he said before And more he saieth not to this Interrogatorie

To the iiijth Interr this deft saieth That the s[ai]d Robte Bates brother & heire of the s[ai]d Tho Bates dyd after the deathes of the s[ai]d Tho Bates & Isabell his wief Clayme an estate of Inherytance of & in the moyty of the s[ai]d messuage & landes before menconed And dyd then allso Clayme an estate of [?freehold?] of & in the s[ai]d advowson donacon & right of p[at]ronage of the rectory & p[ar]ishe Churche of Whalton & of & in thother moyty of the s[ai]d messuage & landes before menconed And this deft verely thincketh that the s[ai]d Robte Bates might lawfully have entred into all & singuler the s[ai]d landes [and] ten[ementes] & have occupyed & enioyed the same ymedyatly after the deathes of the s[ai]d Tho Ba[tes] & Isabell his wyef

To the vth Interr this deft sayth that he doth not knowe of any iust matters ca[uses] or ympedymentes but that the s[ai]d Robte Bates might after the deathes of the s[ai]d Tho: & Isabell Bates lawfully have entred into the said messuage landes & ten[ementes] & att all tymes then after have enioyed the same Butt the reason wherefore the s[ai]d Robte Bates dyd not enter into the same was as this deft thincketh for that the said Wm Fenwyck before menconed dyd after the deathes of the s[ai]d Tho Bates & Isabell his wief clayme to have an estate in the s[ai]d premisses or the most p[ar]t thereof by vertue of a lease alleaged to be made therof unto him by the s[ai]d Tho Bates in his lief tyme And moreover further to this Interr he Cannott depose./.

To the vjth Interr This deft saieth That he doth not knowe That the said Thos Bates dyd in his lief tyme make seale & delyver any granntes Conveyances estate or estates of all or any of the s[ai]d messuage landes ten[ementes] & advowson to the s[ai]d Wm Fenwyck or to any other p[er]son or p[er]sons whereby to hinder the s[ai]d Robt Bates from entringe into the said p[re]misses after the death of the s[ai]d Tho Bates & Isabell his wief

To the vijth Interr this deft saieth That the p[ar]ishe Churche of Whalton aforesaid dyd become voyde of an Incumbent sythence the death of the said Thos Bates and that the s[ai]d Robte Bates as this deft thinketh had the right of p[at]ronage to the said Churche for the same avoydannce by such tytle as is before shewed.

To the viijth & ixth Interr this deft sayth that the s[ai]d Robte Bates had good right & tytle to present a Clarke to the said Churche beinge voyde after the death of the s[ai]d Tho Bates for any thinge this deft doth knowe or understand to the Contrary Butt who dyd present to the s[ai]d Churche being so voyde after the death of the s[ai]d Tho Bates this deft sayth he Cannott depose Butt this deft doth thincke that if any boddy (besydes the s[ai]d Robt Bates) dyd present to the s[ai]d Churche being so voyde of an Incumbent after the deathe of the said Thos Bates the same p[ar]ties so presenting was a wronge doer to the s[ai]d Robte Bates & had not any iust lawfull or trewe tytle so to doe as this deft thincketh And more he sayth not to this Interr./.

To the xth Interr this deft sayth that the s[ai]d Robte Bates is nowe deceased and that the s[ai]d Cuttbert Bates the nowe C[omplainant] is sonne & heire of the s[ai]d Robte & that the s[ai]d Robte was brother & heire of the s[ai]d Tho Bates deceased.

To the xjth Interr this deft saieth That the s[ai]d C[omplainant] may lawfully enter into & occupy the s[ai]d messuage landes & ten[ementes] for any thing this deft knoweth or understandeth to the Contrary./

To the xijth Interr this def sayth that he hath hard that there hath byn suyte sythence the death of the s[ai]d Thos Bates in the Queenes Ma[jesties] Court of Channcery at Westm[inster] betwixt the said Wm Fenwyck therein then Complt & the said George Gray then defendt Conc[er]ning the s[ai]d lease in the bill menconed supposed to be made by the s[ai]d Tho Bates in his lief tyme to the said Wm Fenwyck Conteyning a supposed grannt of the s[ai]d Capitall messuage & landes in Lyttle Bempton in the bill menconed & the advowson of the s[ai]d Church of Whalton aforesaid And further this deft sayth that the s[ai]d suyte was as he verely thincketh comensed and prosecuted by the mutuall pryvety and assents of the s[ai]d Wm Fenwyck Geo: Graye & Marke Errington Butt at whose Charges the same suit was prosecuted or further to this Interr This deft saith he Cannott depose savinge he sayth that the said Wm Fenwyck was the man that first told this deft of the said suyte/.

To the xiijth Interr this deft saieth that he hath seene the seale of Armes of the said Thos Bates sythence the decease of the s[ai]d Tho upp[on] the finger or Thumbe of the s[ai]d Mark Errington

To the xiiijth Interr This deft saieth that above half A yeere after the death of the said Thos Bates the said George Graye Came unto him this deft being at his house at Tynmouth aforesaid in the names of Wm Fenwyck & Marke Errington & sayd unto this deft that the said Wm Fenwyck had entred into bond w[i]th & for the said Tho Bates in his lyef tyme unto the Countesse of Northumberland for payment unto her of one hundred eighteene pounds xiijs iiijd & that he the s[ai]d Willyam Fenwyck was like to paye the same debte of his owne purse to the s[ai]d Countesse not havinge as he s[ai]d receyved any proffitt or penny from the s[ai]d Tho Bates in his lyef tyme towardes the same & therefore prayed this deft bothe by himself & in the names of the said Wm Fenwyck & Marke Errington to drawe an Indenture of lease in the name of the s[ai]d Willm Fenwyck of the said Capitall messuage or ten[emente] called Lyttle Bempton & all the landes ten[ementes] & heredytam[ents] w[i]th thap[ertenances] therunto belonging in Lyttle Bempton aforesaid & allso the advowson donacon & right of patronage of the rectory & p[ar]ish Churche of Whalton in the s[ai]d County of Northumberland w[i]th all & singuler the rightes & app[ertenances] therunto belonging to begynne & take effecte after thende & expiracon of the naturall lyves of the s[ai]d Tho Bates & Isabell his wyef for & during the ende & terme of xljth yeeres next & ymedyatly following fully to be C[om]pleat & ended or words to that eff[ect] And this deft sayth that the said Wm Fenwyck dyd afterwardes come unto him this deft & made such request unto him this deft as the s[ai]d Graye had before donne wher[upon] he this deft after the decease of the s[ai]d Tho Bates dyd drawe & penne an Indenture of lease in the name of the s[ai]d Tho Bates to the s[ai]d Wm Fenwyck accord[ing]ly and sayth that the s[ai]d Wm Fenwyck dyd desire him this deft that the s[ai]d Indenture of lease so by this deft made in the name of the s[ai]d Tho Bates after the decease of the s[ai]d Thos Bates as afores[ai]d [?mought?] be made to beare date in June in the xxixth yeere of her Ma[jesties] raigne for that the s[ai]d Tho Bates about that tyme laye sicke at Islington neere London & for [?that allso?] the s[ai]d Wm Fenwyck & this deft were there w[i]th him at the tyme & by that meanes the s[ai]d lease would Carry the more Credytt as the s[ai]d Wm Fenwyck then sayd unto this deft .... .... .... .... .... .... so made & .... unto this deft by the s[ai]d Wm Fenwyck so this deft dyd make the s[ai]d lease to beare date the xvijth day of June in the xxixth yeere of her Ma[jesties] raigne that nowe is and moreover this deft sayth that the said Geo Graye Wm Fenwyck & this deft had Conference & Consultacon together for some wyttnesses to be procured to testyfye the sealing & delyvery of the s[ai]d lease and in thende the s[ai]d Fenwyck Graye & this deft dyd bethinck them of three p[er]sons whome they thought they might p[ro]cure to be wyttnesses to the s[ai]d lease namely one Tho Franck Symon Chambers & one Anthony Anderson And afterwardes the s[ai]d Geo Graye dyd by this defts dyrecon procure the s[ai]d Symon Chambers & Antho Anderson to take upp[on] them to be wyttnesses to the sealing & delyvery of the s[ai]d lease if they should be called therunto And this deft himself dyd likewise take upp[on] him to be A wyttnes therunto And more he sayth not to this Interr

To the xvth Interr this deft sayth that the s[ai]d Wm Fenwyck & Randall Fenwyck his brother dyd after the deathes of the s[ai]d Tho: Bates & Isabell his wyef enter into the moyty or one half of the s[ai]d Capitall messuage & landes in Bempton afores[ai]d & allso the s[ai]d Wm Fenwyck dyd then likewise as this deft thincketh enter into the s[ai]d p[ar]sonage or rectory in the bill menconed & as this deft [thinketh] dyd take the rentes yssues & proffitts therof & after the ende & expiracon of the lease of [?one Oliver?] who was tenante of thother moyty of the s[ai]d messuage & landes in Bempton afores[ai]d the s[ai]d Wm Fenwyck & Randall Fenwyck his brother dyd enter into the s[aid] other moyty of the s[ai]d Capitall messuage & landes in Bempton afores[ai]d & recyved & yet doth receyve the rentes yssues & proffitts thereof by force of the s[ai]d forged lease before menconed Butt of what value the said premisses are this deft sayth he Cannott depose/

To the xvijth xviijth & xixth Interr This deft saith Thatt the said Wm Fenwyck & George Graye dyd after the deathe of the said Tho Bates & Isabell p[ro]cure him this deft to wryte the said Indenture of lease of the said Capitall messuage landes & advowson before menconed And allso this deft sayth that the said Gr[aye] used the name allso of the s[ai]d Marke Erring[ton] to him this deft about the making of the same Indenture of lease saying that the said Marke Errington dyd thincke ytt very Fytt that such a lease should be made And this deft saieth that the said Mark Errington was allso assenting to him forging & contryving of the said lease for this deft sayth that the s[ai]d Marke Erring[ton] dyd in the presence of this deft after the seath of the s[ai]d Tho B[ates] sett the seale of Armes of the s[ai]d Tho Bates to the same Indenture of lease & allso dyd subscribe the name of the s[ai]d Tho Bates to the same & allso dyd indorse upp[on] the backe of the same Indenture the name of Tho Francke Symon Chambers & Antho Anderson as wyttnesses to the sealing & delyvery therof all w[hi]ch this deft was present att & dyd see donne And allso this deft himself dyd then allso indorse his owne name as A wyttnes to the same Indenture of lease And this deft doth [?so undoubtedly?] p[er]swade himself that the s[ai]d other Indenture nowe shewed unto him this deft conteyning only a supposed grannt of the advowson & patronage of the s[ai]d p[ar]ishe Churche of Whalton afores[ai]d hath byn likewise forged & Contryved synce the death of the s[ai]d Tho Bates and he is moved so to be p[er]swaded for that the said Graye after the death of the said Tho Bates requested him this deft to indorse his name as A wyttnesse to the sealing & delyvering of the same Indenture And another reason w[hi]ch moveth this deft to be p[er]swaded That the s[ai]d Indenture of the s[ai]d advowson & patronage only is forged is bycause the s[ai]d Tho Bates laye sycke heere at Islington neere London at the tyme when the said last menconed Indenture of the said advowson doth beare date att w[hi]ch tyme this deft dyd kepe Company w[i]th the s[ai]d Tho Bates at Islington & laye there w[i]th him in his Chamber & was seldome or never from him during the tyme of his s[ai]d sicknes there And therefore this deft thincketh he must needes have byn pryvy to the making or to the sealing & delyvery of the s[ai]d last menconed Indenture of the s[ai]d advowson & patronage if any such Indenture had then byn made But by whome the said Indenture of the said advowson only was wrytten or sealed this deft sayth he Cannott c[er]tenly depose neyther can he c[er]tenly say who subscibed the name of Tho Bates to the s[ai]d Indenture of the s[ai]d advowson & patronage only nor who dyd indorse the names of Tho Franck Symon Chambers & Anthony Anderson upp[on] the backe of the same Indenture Only he sayth that he this deft dyd after the death of the s[ai]d Tho Bates at the request of the said Gray indorse his this defts owne name upp[on] the backe of the same Indenture as if he had byn A wytnesse to the sealing & delyvery therof For w[hi]ch cause as allso for the reasons before shewed this deft doth verely p[er]swade himself that the same Indenture of the said advow[son] & patronage only is likewise a forged & Counterfett wryting and is the rather moved so to thincke for that it beareth date the day of the date of the s[ai]d other forged Indenture of the s[ai]d Capitall messuage landes & advowson before menconed & is likewyse ...... to be made betwixt the same p[ar]tyes and this deft saith that the said Indenture of lease Conteyning a supposed grannte of the s[ai]d Capitall messuage landes & advowson before menconed was sealed by the s[ai]d Marke Errington above half a yeere after the death of the s[ai]d Tho: Bates in A chamber in the howse of one George Bourne in Newcastle in the presence of George Gray Wm Fenwyck & this deft & of no other p[er]son or p[er]sons ..... And further sayth that the s[ai]d Marke Errington dyd then & there in the presence of this deft & of the s[ai]d other p[er]sons subscybe the [name] of the said Thos Bates to the same Indenture & dyd allso then & there indorse the names of Tho Francke Symon Chambers & Antho Anderson as wyttnesses therunto & this deft dyd then & there indorse his name allso as a wyttnes to the same Indenture And sayth that the same Indenture is nowe as he thincketh in the custodie of the s[ai]d Wm Fenwick And that to this defts knowledge there were not any other p[er]son or p[er]sons pryvy to the making sealing subscribing or indorsing of the same last menconed Indenture but only the s[ai]d Errington, Fenwyck Gray & this deft And touching the s[ai]d other Indenture ...... the s[ai]d advowson & patronage only this deft saieth as he said before And more he Cannott depose to the s[ai]d Interr

To the xxiiijth Interr this deft saieth That he dyd not gyve the s[ai]d Indenture of the s[ai]d advowson & patronage only or the s[ai]d Indenture of the s[ai]d Capitall messuage & landes in Little Bempton & the advowson of the s[ai]d Church of Walton before menconed or any p[ar]te of the same Indenture in evydence in any of her Ma[jesties] Courts of recorde Neyther dyd he this deft in any sorte publish or mayneteyne the said Indenture of the s[ai]d Capitall messuage & landes or any p[ar]t therof or the s[ai]d other Indenture of the s[ai]d advowson & patronage only or any p[ar]te therof to be good iust or trewe to any p[er]son or p[er]sons save only that he this deft when he was first questyoned w[i]thall by the s[ai]d C[uthbt] & Robte Bates concerning the s[ai]d Indenture of lease of the s[ai]d Capitall messuage & landes in Lyttle Bempton & the advowson of the s[ai]d Church of Walton before menconed he dyd by [?waye of Co....?] saye & affyrme that the same last menconed Indenture was the trewe & lawfull deed of the s[ai]d Tho Bates & by him the s[ai]d Tho Bates in his lyef tyme sealed & delyvered to the s[ai]d Wm Fenwyck as his act & deed whereas in very truth yt was not so as is before shewed Butt as touching the supposed publishing of either of the s[ai]d Indentures nowe shewed unto him this deft or any p[ar]t or p[ar]tes therof by the said Wm Fenwyck Mark Errington & George Gray or any of them this deft sayth he [?Cannott certenly?] depose of his owne knowledge otherwise or further then he hath before deposed Nev[er]theles he sayth that he is verely p[er]swaded that the s[ai]d Marke Errington Wm Fenwyck & Geo Graye or some or one of them have published & mayneteyned the said Indenture of the s[ai]d Capitall messuage & landes in Lyttle Bempton & the advowson of the s[ai]d Churche of Whalton To be a good iust & trewe deed And more or further to this Interr he Cannott depose./

To the xxixth Interr This deft saieth That shortly after the death of the s[ai]d Tho Bates & shortly after the subscribing sealing & indorsing of the said Indenture wrytten by this deft as afores[ai]d The said Wm Fenwyck & the s[ai]d Geo Graye had Conference & Consultacon before menconed w[i]th this deft at Newcastle & at this defts s[ai]d [howse] for & about the proving of the s[ai]d Indenture of lease so wrytten by this deft as afores[ai]d and to that ende the s[ai]d Willyam Fenwycke & the s[ai]d George Graye dyd procure him this deft to wryte A l[etter] & to send the same l[etter] to [?be ...?] by the s[ai]d George Graie to the said Symon Chambers & Anthony Anderson (being men w[i]th whome this deft was acquaynted) reques[ting] them thereby to be wyttnesses & to testyfy on the behalf of the s[ai]d Wm Fenwyck that the s[ai]d Thos Bates dyd in his lyef tyme in the presence of them the s[ai]d Chambers & Anderson seale & as his acte & deed delyver to the s[ai]d Wm Fenwick the s[ai]d lease wrytten by him this deft as afores[ai]d w[hi]ch s[ai]d l[etter] so wrytten & sent by this deft to the s[ai]d Chambers & Anderson was by the s[ai]d Gray d[elivere]d to the s[ai]d Chambers according as this deft hath hard & thincketh itt to be trewe And further this deft sayth that the s[ai]d Mark Errington had allso talk w[i]th the s[ai]d Fenwyck and Graye at Newcastle afores[ai]d howe & by what meanes the s[ai]d Anderson and Chambers might be brought & p[er]swaded to testyefye the sealing & delyvery of the s[ai]d lease so wrytten by this deft after the death of the s[ai]d Tho Bates as aforesaid and more he saieth not to this Interr/

To the xxxth Interr this deft sayth he can say no more then he hath before said to the xxixth Interr/

To the xxxjth Interr this deft sayth that he hath hard that [in the] month of Maye in the xxxijth yeere of her Ma[jesties] raigne that nowe is Symon Chambers & Anthony Anderson were sworne & examined in the s[ai]d Courte of Channcery on the behalf of the s[ai]d Wm Fenwick against the s[ai]d George Gray concerning the s[ai]d Indenture of lease Conteyning a supposed grannt of the s[ai]d Capitall messuage & landes in Lyttle Bempton afores[ai]d & the advowson of the s[ai]d Church of Whalton wrytten by this deft as aforesaid and this deft thincketh that the s[ai]d Anthony Anderson and Symon Chambers were sworne & examined at the costes & Charges of the said Willyam Fenwyck and further he sayth not to this Interr/.

To the xxxijth Interr this deft saieth that he hath hard & thincketh yt to be trewe that the said Mark Errington Wm Fenwyck & Geo Gray dyd consent & agree amongst them selves to have the s[ai]d Symon Chambers & Antho: Anderson to be sworne & examined for the p[ro]ving of the s[ai]d Indenture of lease wrytten by this deft as afores[ai]d and further to this Interr this deft saith as he s[ai]d before And more he sayth not to this Interr./.

To the xxxiijth & xx[x]iiijth this deft saieth that he hath seene the Coppyes of the deposicons of the s[ai]d Symon Chambers & Antho Anderson taken in the s[ai]d Court of Channcery betwixt the s[ai]d Wm Fenwyck & the s[ai]d Geo: Gray Conc[erning] the s[ai]d Indenture of lease wrytten by this deft after the death of the s[ai]d Tho Bates as aforesaid and further this deft saieth that the Coppyes of the deposicons nowe shewed unto him this deft at the tyme of this his examynacon are as he thincketh the trewe Coppies of the deposicons of the s[ai]d Symon Chambers & Antho Anderson taken in the s[ai]d Cause in the said Court of Channcery betwixt the said Wm Fenwyck & George Graye and further to this Interr this deft sayth as he s[ai]d before and more he deposeth not to this Interr.

To the xxxvth xxxvjth & xxxvijth Interr he is not examined

To the xxxviijth Interr he sayth he can depose no more then he hath before deposed.

To the xxxixth Interr he sayth that the s[ai]d Symon Chambers was drowned at the sea above twoe yeeres nowe past as this deft hath byn Credibly informed And this deft sayth that he dyd knowe the said Symon Chambers for the space of tenne yeeres or thereabowtes before his death & that during all the tyme of this defts knowledge of the s[ai]d Symon Chambers the s[ai]d Symon was accompted to be A man of A very lewde Conversacon & disposicon And more he sayth not to this Interr

To the first Interr[ogatory] This deft saieth That he dyd knowe one Tho Bates late of Morpeth in the County of Northumberland deceased but dyd not knowe Isabell his wief neyther doth he knowe when or where the said Thos or Isabell dyed Neyther doth he knowe Mark Errington nor Wm Fenwyck in this Interr menconed Butt sayth that he doth knowe Geo: Graie in thinterr menconed & dyd knowe Symon Chambers in the Interr menconed when he was lyveing. And further saieth that he did knowe Tho Bates for the space of xiiijten yeeres before his death or thereaboutes. And further saith that he dyd knowe Symon Chambers for the space of sixe or seven yeeres before he dyed or thereaboutes And hath knowen the said Geo: Graie for the space of fowertene yeeres past or thereaboutes as he now re[mem]breth

To the xxiiijth Interr This deft saith that at such tyme as he this deft was to be exam[ine]d in her Ma[jesties] Court of Channcery betwixt one Wm Fenwycke & the said George Graie he the said Graye did shewe unto him this deft a certain Indenture of lease made in the name of the said Tho Bates to one Wm Fenwycke conteyning as this deft re[mem]breth a supposed demys of a certain messuage or ten[emente] called Lyttle Bempton & of the advowson of a p[ar]sonage in Northumberland & perswaded him this deft to depose in the s[ai]d Court in the s[ai]d cause that his name indorsed upp[on] the backe syde of the same lease was of his owne hand wrytinge & that he was present w[i]th those others whose names were likewyse indorsed upp[on] the backe side of the same Indenture at such tyme as the s[ai]d Thomas Bates dyd seale & as his acte & deed delyver the same Indenture to the s[ai]d Wm Fenwyck And allso the said George Graie dyd then likewise will him this deft to mark diligently in what manner the name of this deft was indorsed upp[on] the same Indenture to thende that when this deft had p[re]sented his exa[minaco]n he should wryte his name to thende of his said exa[minaco]n in the self same forme or at leastwise as neere as he Could to the shape & proporcon of his name indorsed upp[on] the backesyde of the said Indenture And this deft sayth that there was a l[etter] sent & d[elivere]d as this deft hard by Robt Helme one other of the nowe defts to the s[ai]d Symon Chambers as the s[ai]d Symon told this deft whereby (as the s[ai]d Chambers told this deft) he this deft & the s[ai]d Chambers were requested by the s[ai]d Robte Hellme to testyfy the seal[ing] & delivery of the s[ai]d Indenture of lease by the s[ai]d Tho Bates in his lyef tyme to the s[ai]d Wm Fenwycke In respect of w[hi]ch said l[etter] from the s[ai]d Helme whoe was this defts good frend & thorogh the p[er]suasyon of the s[ai]d Graye who affyrmed unto this deft that the s[ai]d matter would never come into question This deft was moved to depose in the s[ai]d Court of Channcery that he was present at the sealing & dely[very] of the s[ai]d Indenture of lease by the said Tho Bates in his lyef tyme [to] the s[ai]d Wm Fenwyck whereas in very truth this deft was never present att any such matter as he in his said deposicons taken in the s[ai]d Court of Chancery hath untruly deposed neyther in very truth doth this deft knowe the said Wm Fenwick nor to his re[mem]brance dyd ever see the s[ai]d Wm Fenwyck And further saith that the s[ai]d Chambers did dyvers tymes before this defts s[ai]d deposing talk labor & p[er]swade him this deft so to depose as he dyd tell him this deft that he the s[ai]d Chambers would depose therein as much as this deft & that he was suer the matter would never come any further into question & allwayes dyd putt this deft in mynde of the l[etter] of the said Robt Hellme who was this defts frend w[hi]ch l[etter] was the specyall cause w[hi]ch moved this deft so to depose as he dyd and more he saith not to this I[nterr].

To the xxvth xxvith xxvijth & xxviijth Interr he is not exa[mined]

To the xxixth & xxxth Interr this deft sayth he can say no more then he hath before said to the xxiiijth In[terr]

To the xxxjth In[terr] This deft sayth that the said Symon Chambers & this deft were sworne & exa[mined] in the s[ai]d Court of Channcery on the behalf of the said Wm Fenwyck against the said Geo: Graye concerning the said Indenture of lease before menconed about Maye in the xxxijth yeere of her Ma[jesties] raigne that nowe is And this deft sayth that the said Geo: Graye dyd as this deft thinketh laye forth all Fees & charges that dyd belonge or were due for the taking of the s[ai]d examynacons And this deft saieth that he this deft is the same Anthony Anderson that was so p[ro]duced sworne & examyned in the s[ai]d Cause in the s[ai]d Court of Channcery as aforesaid./

To the xxxijth Interr this deft saieth he can say no more then he hath before said.

To the xxxiijth & xxxiiijth Interr This deft saieth that the Coppyes of the deposycons of the said Symon Chambers & of this deft nowe shewed unto him this deft at the tyme of this his examynacon are as he verely thinketh the trewe Coppyes of the deposicons of the said Symon Chambers & of this deft taken in the said Court of Channcery betwxit the said p[ar]ties conc[er]ning the said Indenture of lease before menconed And this deft further sayth that whereas upp[on] his s[ai]d examynacon taken in the said Court of Channcery he dyd depose to the first Interr to him then mynistred in the s[ai]d Courte betwixt the said Wm Fenwyck pl[aintiff] & the said Geo: Graye deft That he dyd knowe the p[ar]ty pl[aintiff] in the s[ai]d cause w[hi]ch was Wm Fenwyck he dyd therein depose untruly for he sayth that he neyther then dyd nor yet doth knowe the pl[aintiff] Wm Fenwyck nor to his remembrance dyd ever see the same Willyam Fenwyck And whereas this deft upp[on] the .... his said examynacon taken in the said Court of Channcery dyd then depose to the second Interr to him then ministred in the s[ai]d cause betwixt the s[ai]d p[ar]tyes That he dyd well knowe & remember That the s[ai]d Thomas Bates dyd in his lief tyme make or cause to be made an Indenture of lease betweene the s[ai]d Tho Bates of thone p[ar]tie & the s[ai]d Wm Fenwyck then Complt of thother p[ar]tie Conteyning a demise of a c[erten] messuage or ten[emente] called Lyttle Bempton & of the advowson & free disposycon of the p[at]ronage of Whalton in the County of Northumberland for that he was present at the sealinge and delyvery of the same lease by the said Thomas Bates then lyinge sicke in his bedd at the signe of the white horse in Islington in the County of Midd he this deft dyd therein depose untrewly For that this deft sayth that in very truth he was not present at the sealing & delivery of any such lease by the s[ai]d Tho Bates neyther doth this deft knowe that the s[ai]d Tho Bates dyd in his lyef tyme make or cause to be made any such lease as he this deft in his s[ai]d deposicon to the s[ai]d second Interr mynistred unto him in the s[ai]d Cause & Court of Channcery hath untruly deposed And whereas this deft in his deposicon to the third Interr to him mynistred in the s[ai]d Cause & Court of Channcery dyd depose that one Robte Helme did read one p[ar]te of the said Indenture to the said Thomas Bates who afterwardes dyd subscribe his name thereunto & then dyd seale & delyver the same as his deed to the s[ai]d Wm Fenwyck The same Tho Bates then lying sicke in his bedd as aforesaid about twoe or three of the Clocke in the afternoone as this deft re[mem]bred in the presence of him this deft & the s[ai]d Robert Helme & one Symon Chambers servannt to the s[ai]d Tho Bates he this deft dyd therein likewyse depose untruly For in very truth this deft sayth that he dyd never heare the s[ai]d Robte Helme read any p[ar]te of the s[ai]d Indenture to the s[ai]d Thomas Bates neyther dyd this deft ever see the s[ai]d Tho Bates subscribe his name to any such Indenture neyther dyd he this deft ever see the said Tho Bates seale & delyver as his deed any such or uther Indenture to the s[ai]d Wm Fenwyck neyther dyd or doth this deft knowe the s[ai]d Wm Fenwyck And whereas this deft to the fowerth & vth Interr to him ministred in the s[ai]d Cause & Court of Chancery dyd depose that the Indenture then shewed unto him by the Examyner in the tyme of his Examinacons he knewe to be the self same Indenture w[hi]ch the said Tho: Bates sealed & delyvered as aforesayd he this deft dyd therein likewise depose untruly For he saith he never sawe or knewe the same Indenture to be sealed & d[elivere]d by the s[ai]d Tho Bates as he deposed And whereas this deft to the same iiijth & vth Interr dyd further depose that he dyd take ytt & dyd verely thincke & beleeve that the name of Antho Anderson indorsed on the back syde of the s[ai]d lease to be of his owne p[ro]per hand wrytinge he dyd therein likewise depose untruly for he dyd well knowe that the name of Antho Anderson indorsed on the backside of the s[ai]d lease was not of this defts owne hand wrytinge but Counterfetted For w[hi]ch offences so by the deft Comytted as afores[ai]d he is very hartely sorry & doth humbly desire allmighty god & allso her Ma[jestie & this ho[norable] Court to have pytty & Compassion upp[on] him & to I.... the same his offences And more he saith not to these Interr

To the xxxvth Interr this deft saith that there were not any some or somes of money [nor] yet, any other guiftes rewardes or Consideracons gyven bestowed or p[ro]mised unto him this deft to depose in the s[ai]d Court of Chancery in the s[ai]d cause betwixt the s[ai]d Wm Fenwyck & the s[ai]d Geo: Gray But sayth that he was moved & p[er]swaded to depose in the s[ai]d cause by such meanes as he hath before allreddy shewed/.

To the xxxvjth Interr This deft saith that he was not present at the sealing & delyvery of any such Indenture of lease betwixt the s[ai]d Tho Bates of thone p[ar]tie & the s[ai]d Wm Fenwyck of the other p[ar]tie as is menconed in the Interr neyther was he this deft at any tyme present at the sealing & delyvery of any other Indenture or Conveyance betwixt the same p[ar]tyes. And further to this Interr he saith as he hath befores[ai]d And more to this Interr he Cannot depose./.

To the xxxvijth Interr this deft saieth that the name of this deft indorsed upp[on] the said Indentures were shewed unto him this deft att the tyme of this his examynacon bearing date the xvijth daye of June in the xxixth yeere of her Ma[jesties] raigne that nowe is & menconing to be made betwixt the said Tho Bates & Wm Fenwycke is not of the hand wrytinge of this deft neyther was he this deft present at the sealinge & delyvery of the same Indenture or eyther of them & doth verely thincke & p[er]swade himself in his Conscyence that both the same Indentures are Conterfetted & forged for that the name of him this deft indorsed uppon both the same Indentures is Counterfeted to the the same Indentures

To the xxxviijth Interr he saith he Can say no more then he hath before said

To the xxxixth Interr he sayth that the s[ai]d Symon Chambers is deceased as he thinketh And that the s[ai]d Symon when he lyved dwelt in London & lyved in the profession of A Marchant But was in very truth a very badd & a lewde fellowe & a man of small or no Credytt at all And more he saith not to this Interr
