Interrogatories:

[Interrogatories to be ministred] to Marke Erington & William Fenwicke gent defendts one the behalfe of the Reverend Father in god Johne Perce late L[ord] Byshoppe of Sarum and Almoner to her Ma[jestie] & now archbushoppe of Yorke Complaynant

Imprimis whether do you certenly know or thinke to be trew That Thomas Bates of Prudhow in the County of Northumberland stood bound w[i]th one Robart Helme of Tynmouth in the said County to Henry lat[e] Earle of Northumberlande in eightschore powndes for paym[en]t of fower schore to the said Earle And whether doe you certenly know of your owne knowledge that the said some was payd to the said Earle before his dethe yf yea by [w]home, when, where & in whose p[re]sence

[2] When did you first heire or understande of the said bonde and debte & for whose debte was the said bonde made; eyther for the debte of the said Thomas Bates or for the debte of the said Robart Helme; or for som[e] ioynt debte or som[e] sev[er]all debtes of them both, and doe you not know or have harde that the said Earle did lende any some or somes of money to the said Robart Helme and Thomas Bates, for assurance of paym[en]t wherof the said bonde was made

3 Doe not you know or have harde that the said Bates did receive any somes of .... the said Robart Helme taken upp by him of the Rents & revenues of the landes of the said Earle .... when did the said Robarte Helme make his last accounte to the said Earle or any his officer to your knowledge, and what prouffe can you alleage that induceth you to thinke that any p[ar]te of the said debte due uppon the said bonde was discharged & payed by the said Helme or the said Bates to the said Earle in his lyfe tyme yf you knowe any declare the certenty and p[ar]ticulers thereof at large

4 How do you know that the said Helme was imprisonned and under arrest at the sute of the saide Earle since the said obligacon made/ Were you p[re]sent at his arrest or saw him in prison And for what debte duty or other cawse was he so arrested and imprisoned and howe longe is it since he was so arrested, And was not the said Helme receaver to the said Earle after the said arrest

5 Whether doe you know, that the said Earle had any conveyance of any landes from the said Robart Helme or Thomas Bates or eyther of them since the said obligacon, made, yf yea what landes were so conveyed, and for what consideracon or some of money geven And did you ever see any soch conveyance, or what certen knowledge by any other meanes have you of any soch conveyances, declare the certenty therof/ or els doe you only speake by your owne imaginacon and uppon noe certen grounde:

6 Whether did the said Thomas Baytes dye intestate or did he make a will and were you not a meane And a specyall procurer That an administracon of his goodes and Chattels were grannted to Isabell his wyffe And did not you enter into bondes or p[ro]cured some other to enter into bondes to the ordynary uppon the said administracon comitted ~

7 Whether was it agreed betwene you and the said Isable before the said Administracon taken that you Marke Erington & William Fenwicke should deale in the Administracon of the said goodes and were you not privy to the said appraysem[ent] made of the said goodes by the p[er]sons mencyoned in your awnsweres and did not you request or speake to any of the said p[er]sons to be one of the praysers of the said goodes ~ ( ..

8 Whether did you geve or promise any rewardes unto any the said p[er]sons for their labor taken in praysing the said goodes, and did not you request & intreate them or some of them to prayse the same goodes at a smale price, and are not the same p[er]sons or some of them aleyed to you in bloode or by mariadge

9 Whether doe you thinke in your Conscience that the said goodes were praysed as they were worth in truth and have not you sold any p[ar]te of the said goodes for A greater pryce then they were so praysed, yf yea shew p[ar]ticulerly what goodes, for what some, and to what p[er]son or p[er]sons

10 Doe you not know that some goodes and chattels w[hi]ch were the said Thomas Bates at his death were concealed & lefte out of the said Inventory conteyned in a sedule annexed to your awnswere yf yea shew p[ar]ticulerly what goodes and of valew the same were & to whose handes and possession the same came and what goods and chattles of the said Thomas Bates not conteyned in the said Inventory came to your handes since his death and of what valewe were the same

11 Whether doe you know of any debte dew to the said Thomas Bates at his death w[hi]ch was not sett downe in the said Inventory and have not you or the said Isable w[i]th your privyty released or discharged or compounded for any soch debte or debtes and to whome did you sell the saide lease of Netherton mencyoned in your awnswere and for what price Whether did you sell all soch goodes as came to your handes of the said Bates at the same price that they were praysed in the Inventory and to what p[er]sons did you sell the same declare their names p[ar]ticulerly, or as many as you canne remember and had you noe further consideracon or benefitte of any soch p[er]son dyrectly or indyrectly in respecte of the sale of the said goodes but only the price sett downe in the said Inventorye

12 Whether have you payed all the sev[er]all somes sett downe in the sedules mencyoned in your awnsweres & annexed to the same, to the p[er]sons therin named as debtes dew to them by the said Thomas Bates and did not you compounde w[i]th any of them for A lesser some/ how did the said debtes appeare to be dew debtes and declare p[ar]ticulerly, and expresse and sett downe upon the margent of the Coppy of the said sedule now shewed to you at your examinacon w[hi]ch of the said debtes were by specyalty and w[hi]ch were not

13 Have you disbursed all soch p[ar]ticuler somes as ar expressed in the said sedule to be disbursed about the funeralles of the said Thomas and Isabell Bates, and where doth it appeare or how canne you make it appeare that you disbursed the iijxx xjli 18s 3d sett downe in the said sedule emonge your disburs[ements] for suites in law/ whether have you any p[ar]ticuler note therof yf you have subscribe your name to them to thend the same maye be shewed to this Ho[norable] Court/ and whether are the same notes trew, and nothinge sett downe therin but that w[hi]ch you disbursed and layed out in deed.~/

14 Did yow geve unto George Graye three powndes for his charges to London when he payed the twenty powndes to Mr Watson (as is mencyoned in the said sedule) and did the said Graye goe to London for noe other purpose and whether doe you thinke hit reasonable to aske allowance of iijli for the travell to paye twentye powndes And how did hit appeare to you that Robart Helme had disbursed vijli vjs viijd for Thomas Bates for A suite in lawe (as ys mencyoned in the said [sedule] ....... that the s[ame] was a dew debte; and not discharged or payed by the said Bates in his lyffe tyme

15 Whether did the said Thomas Bates owe unto you therty two powndes fiftene shillinges two pence debte the p[ar]ticulers wherof are sett downe to be owinge to yow in the thirde sedule annexed to your said Awnswere w[hi]ch of the said debtes were by specyalty and w[hi]ch not, and whether had not you eyther released or otherwise in law discharged any of the said debte or were not you satisfied of the same or any of them in the lyffe tyme of the said Thomas Bates

16 Whether did you in the lyffe tyme of the said Isable assume to paye to the p[er]sons named in the said thirde scedule annexed to your awnswere the said sev[er]all somes therin conteyned amountinge to seven & fyftye powndes seven shillings and what sev[er]all consideracons were geven you to induce you to make the said sev[er]all assumptsites and p[ro]mises and when did you make the said assumpsittes and had not you knowledge of the bonde of eight hundred powndes before the said assumpsittes made

17 To what p[er]son did you William Fenwycke stande bonde for the said Thomas Bates in the some of twoe hundred powndes or therabout (as you have alleaged in your awnswere) for the payment of one hundred & eightene powndes therteen shillinges fower pence beinge the dew debte of the said Bates, and when did you paye fiftye eighte powndes thertene shillings fower pence or therabout of the said debte whether in the lyffe tyme of the said Bates or since his death, and to whome payed you the same and where and who were p[re]sent at the paym[en]t therof ~

18 Of what valew are the leases goodes and chattels w[hi]ch were the said Thomas Bates at his death and confessed in your awnswere to be in your handes, and not mencyoned in the said Inventory and for what reason were the said leases goodes and chattles left out of the said Inventory and what landes do you know that are discended to the said Thomas Bates his heires, declare the p[ar]ticuler therof to the beste of your knowledge \\\\

Marke Errington of Pontiland w[i]thin the County of North[umberland] &c sworne

To the first In[terrogatory] this def[endant] saithe he doth not know or thincke to be trewe that Tho Bates menconed in the In[terrogatory] was bounde w[i]th Robt Hellme in the Inter[rogatory] allso menconed in any bond of viijxx poundes for paym[en]t of iiijxxli to the late Erle of North[um]berland nether doth this def[endant] knowe of the paym[en]t of fower score poundes upp[on] any such bond before the s[ai]d Earles deth as is allso supposed

To the second In[terrogatory] this def[endant] sethe as he hath before said in his awnswere to the Inter[rogatory] [?.... p.....?] And that he this def[endant] dothe not know that the s[ai]d Erle did lend any sume or sumes of money to the s[ai]d Robt Helme & Tho Bates for paym[en]t wherof any bond of viijxxli was made as is supposed

To the 3 In[terrogatory] this def[endant] sethe It is trewe [?.... .. ..?] said Robt Helme in the In[terrogatory] menconed did gather or take up rents for the s[ai]d Erle But whether the s[ai]d Bates did receyve of the s[ai]d Hellme any of ye money so by him the s[ai]d Hellme taken up or not this def[endant] doth not know But the last account w[hi]ch the s[ai]d Hellme made to the s[ai]d Erle was as this def[endant] thinketh a little before such tyme as the s[aid] Helme was in prison in the Compter in Wood Streete in the White [?Horse?] in Southwarke the tyme otherwise certenly he knoweth not And further this def[endant] sethe as he hath before said to the first & second Interr[ogatories]

To the iiijth Inter[rogatory] concernethe the supposed obligacons menconed for ..... therof as in the first Int[errogatory] this def[endant] sethe as he hath said before and further saith that he is well assured that the said Hellme was in prison as aforesaid att the suyte of the s[ai]d Erle for this def[endant] saith he .... him ... ... of ye said pris[on]s before menconed howbeit this def[endant] was not present at the s[ai]d arreste neyther doth this def[endant] knowe for what cause the s[ai]d Hellme was so arrested .. ..... .... therupon ... that yt was said he was so imprisoned for debt by him owing unto the s[ai]d Erle And moreover this def[endant] sethe that yt is above vij or viij yeres since the said arrest, sayeth also that the s[ai]d Hellme was not recyver to the s[ai]d Erle after the s[ai]d arrest to the knowledge of this def[endant]

To the vth Int[errogatory] this def[endant] sethe as before And that he doth suppose that the s[ai]d Erle had Conveyance of certen landes in [?Act..?] in the county of Northumb[er]land from the s[ai]d Bates But this def[endant] did [?never see?] the same conveyance nor doth knowe for what consider[acon] or some of money the same Conveyance was so made Nev[er]theles the s[ai]d Conveyance (as this def[endant] hard) was made by the s[ai]d Bates to the s[ai]d Erle in satisfacon or paym[en]t of certen money owing by the s[ai]d Bates to the s[ai]d Erle but this def[endant] of his owne knowledge Canne say no .... in that behalf

To the 6 In[terrogatory] this def[endant] sethe that the said Tho Bates did dye intestate And that he this def[endant] did not p[ro]cure or use any meanes wherby the administracon of his goodes & chattles were granted to Isabell his wief But this def[endant] sethe that at the ernest request & suite of Mrs Bates, this def[endant] with others entred into bond to the ordynary uppon the administracon granted or comitted to the s[ai]d Mrs Bates

To the vijth In[terrogatory] this def[endant] saith that there was not any such agreem[en]t betwixt this def[endant] & the s[ai]d Isabell as ys menconed in the first p[ar]te of the artycle But this def[endant] sethe that he this def[endant] was present & pryvy at & to the appreysm[en]t made of the s[ai]d goods or of the most p[ar]te therof by & at the [ernest] request of the s[ai]d Mrs Bates nevertheles this def[endant] did not speake to any of the said p[er]sons to preyse any of the s[ai]d goods

To the viijth In[terrogatory] this def[endant] sethe that Robt Errington & Willm Errington twoe of the s[ai]d appreysors & then late the servantes of the s[ai]d Tho Bates were alyed unto this def[endant] but the rest of the Conte[nts] of the artycle as touching the gyving or p[ro]mising of rewards for preysing the said goods or requesting .. ...... in that behalf to any of the s[ai]d apprysors this def[endant] doth utterly denye for his owne p[ar]te

To the ixth In[terrogatory] this def[endant] sethe that all or the most p[ar]te of the s[ai]d goods were as this def[endant] thinketh in his conscyence preysd as in truth they were worthe But this def[endant] sethe that eleven or xij kye were as this def[endant] [?thinketh?] sold by the dyrecons of Will Fenwicke & this def[endant] for the s[ai]d Mrs Bates for a more or greater pryce then they were preysd at but for howe much more this def[endant] cannot certenly tell

To the xth In[terrogatory] this def[endant] sethe that he this def[endant] doth not knowe or understand that the said Tho Bates had any goodes or chattles at the tyme of his death w[hi]ch are not [?c..th..d?] eyther in the answere of this def[endant] to the s[ai]d .... bill or in the scedule annexed therunto ..... certen apparrell of the s[ai]d Tho Bates of little worth all w[hi]ch or the most p[ar]te therof his s[ai]d wyef at & after the tyme of his death dyposed as to her seemed good and this def[endant] sethe that there did not any of the s[ai]d Tho Bates his goodes or chattles synce the death of the s[ai]d Tho Bates come to the handes of this def[endant] [saving] such as [?ben?] sett downe eyther in this def[endants] s[ai]d answere or scedule annexed therunto The p[ar]tyculerityes of w[hi]ch said goodes & the value therof are sett downe in the said answere or scedule annexed therunto.

To the xjth Interr[ogatory] this def[endant] sethe that he this def[endant] synce ye death of the s[ai]d Tho Bates hath [?sene?] certen bondes or billes of debte w[hi]ch were made to the s[ai]d Tho Bates for paym[en]t of certen sumes of money unto the said Tho Bates (the contents wherof this def[endant] doth not re[mem[ber) neyther doth this def[endant] knowe whether the same debtes menconed in the s[ai]d billes or obligacons were paid or due to be p[a]yd or not in respect wherof the same supposed debtes are not sett downe eyther in this def[endants] said answere or scedule annexed therunto nether did this def[endant] or the s[ai]d Isabell by his pryvety release discharge or compound for any of the s[ai]d Tho Bates his debtes as is supposed But this def[endant] sethe that he this def[endant] & Willm Fenwicke gent did sell the lease of Netherton to Robert Bates for the sume of threescore & tenne poundes and moreover this def[endant] sethe that this def[endant] & the s[ai]d Willm Fenwicke did sell to one Robt Furst[er] xxvj cattle at the same pryce that the same cattle were preysed at, & allso sold to James Bourne iiijxx ewes at the same pryce they were preysed, To Robte Bates all or the most p[ar]te of the corne, oxen, & other implements of husbandry at Netherton & Bedlington at the self same pryce as the same were appreysed at as this def[endant] re[mem]breth, To Antho Errington iiij oxen at Benton after such rate as they were preysed at, To James Bourne twoe kie after the rate & pryce they were appreysed at as this def[endant] re[mem]breth And this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke did reteyne in their owne handes [?divers?] p[ar]cells of the s[ai]d Tho Bates his goodes at the same rate or pryce they were appreysed [?this?] same p[ar]cell and being in this def[endants] remembrance no more worthe then they were appreysed att But this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke had not any other beneffitt dyrectly or undyrectly in respect of the sale of the s[ai]d goodes but saith as this def[endant] hath before trewly declared.

To the xijth In[terrogatory] this def[endant] saithe that this def[endant] & the s[ai]d Mr Fenwicke or one of them or some other by their or one of their app.... did paye all the sev[er]all sumes sett downe in the scedule menconed in this def[endants] answere & annexed to the same to the p[er]sons therein menconed as debtes due to them by the s[ai]d Tho Bates, And this def[endant] sethe that the debte due by the s[ai]d Tho Bates to [one] Mr Watts[on] of London & the debt of xli by him due to Willm Darnels was due by specyalty but what other debtes were due by specyalty & what ... this def[endant] cannot clearly sett downe ................................................................ s[ai]d scedule at the tyme of this his exam[inacon] all w[hi]ch said debtes so sett downe in the said scedule & payd as aforesaid appeared unto this def[endant] to be due debtes p[ar]tly of this def[endants] owne knowledge & p[ar]tly by the credible informacon of such as knewe the same to be due But this def[endant] doth denye that this def[endant] did compound w[i]th any of the s[ai]d p[er]sons to whome the s[ai]d Bates was indebted for any lesser sume then was to them due & sett downe in the s[ai]d scedule as is supposed.

To the xiijth In[terrogatory] this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke or one of them have by the othe he hath taken disbursyd all such p[ar]tyculer sums as are expressed in the said scedule to be disbursed about the funerall of the s[ai]d Tho & Isabella Bates but he saith he cannot sett .... downe p[ar]tyculler uppon his othe by ...... he had not the sight of the s[ai]d scedule or any coppy therof at the tyme of this his exam[inacon]

To the xiiijth In[terrogatory] this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke or one of them did [?delyver?] such money unto the s[ai]d Geo Gray as is menconed in the s[ai]d scedule for his charges to London at such tyme as the s[ai]d Geo went to paye the s[ai]d xxli to Mr Watts[on] & he saith that the said Gray went to London to no other p[ur]pose but only to pay the s[ai]d xxli to the knowledge of this def[endant] and this def[endant] thincketh that the s[ai]d Graye could not well spend any lesse sume then that in ryding from North[um]b[er]land to London & from London to North[umberland] againe And this def[endant] further sethe that the s[ai]d Hellme dyd of this def[endants] proper knowledge ryde twyce from North[umberland] to the Cytty of Yorke touching a suite depending there betwixt the s[ai]d Tho Bates & .... Milberne In w[hi]ch twoe jorneys the s[ai]d Helme could not in this def[endants] opynion spend lesse then vijli vjs viijd w[hi]ch s[ai]d vijli vjs viijd (as the s[ai]d Helme protested & affyrmed unto this def[endant]) was not payd ......... Hellme by the s[ai]d Tho Bates in his lyef tyme

To the xvth In[terrogatory] this def[endant] sethe it is trewe that the s[ai]d Tho Bates did owe unto this def[endant] such sumes of money as be sett downe in the scedule menconed in the in[terrogatory] howbeit the same sumes are not due unto this def[endant] by any specyalty, but this def[endant] sethe that xxli therof was due by the said Bates unto this def[endant] as money lent unto the s[ai]d Tho Bates by this def[endants] father & iijli vjs viijd of the s[ai]d debt was recevid by the s[ai]d Tho Bates of Mr Antho Felton gent w[hi]ch the s[ai]d Antho deliv[er]ed unto the s[ai]d Bates to pay over unto this def[endant] & w[hi]ch the said Bates did not pay over unto this def[endant], & iiijli of the s[ai]d debte was due unto this def[endant] by the said Bates as money owing by the said Bates unto this def[endants] father for twoe oxen w[hi]ch the s[ai]d Bates bought of this def[endants] s[ai]d father & fyfty shillinges of the s[ai]d debt was owing by the s[ai]d Tho Bates unto this def[endant] for money disbursed by this def[endant] for the s[ai]d Bates for v yeres rent of Te... Meddow, & viijs vjd of the s[ai]d debt was due unto this def[endant] by the s[ai]d Bates for money w[hi]ch the s[ai]d Bates had of this def[endants] said father at the tyme of his death And this def[endant] doth denye that he this def[endant] was sattisfied of the s[ai]d debtes or of any p[ar]te therof by the s[ai]d Bates or any for him in his lief tyme neyther did this def[endant] release or otherwise gyve any discharge therof or of any p[ar]te therof to the s[ai]d Tho Bates as is supp[os]yd

To the xvjth In[terrogatory] this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke did in the lyef tyme of the s[ai]d Isabell assume to pay to the p[er]sons named in the scedule in the In[terrogatory] menconed the s[ai]d sev[er]all sumes in the same scedule conteyned and this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke were .... to assume so to doe for the discharge of the Credditt of the s[ai]d Tho Bates & Isabell his wief whome they entirely ..... this def[endant] & the s[ai]d Mr Fenwicke being fully p[er]swaded in their conscyences that the same debtes were due to the s[ai]d p[er]sons named in [the] said scedule Butt this def[endant] sethe that this def[endant] & the s[ai]d Mr Fenwicke had not any knowledge of the bond of 800li before the ..... of any of the same assumpsitts saving only [?that?] assumpsit of xxvli made to therle of North[um]b[er]lands officers for the rent of Prudham

To the xvijth In[terrogatory] this def[endant] answereth not for that the same artycle is [?specyally ......?] to Mr Fenwicke the other def[endant]

To the xviijth In[terrogatory] this def[endant] sethe that he this def[endant] cannott by any meanes otherwise value the leases goodes & chattles w[hi]ch were the s[ai]d Tho Bates at the tyme of his death then he hath allredy done in his said answere and the reason why the value therof or of some of them was [?..ytted?] in the s[ai]d Inventory was bycause the same came to the handes of this def[endant] & the s[ai]d Mr Fenwicke after the s[ai]d Inventory was made But what landes discended to the heires of the s[ai]d Tho Bates this def[endant] cannot now p[ar]tyculerly or clerely sett downe w[i]thout taking p[er]usall of some writinges w[hi]ch he hath in the country

Deposition of Willm Fenwicke:

Willm Fenwicke of Blageden w[i]thin the County of Northumb[er]land gent sworne saith

To the first and second Interrogatories this def[endant] sethe that he this def[endant] doth not knowe that or thincke to be trewe That any such bond as ys menconed in the Interr[ogatories] was made to Henry late Erle of Northumb[er]land by Tho Bates in the Interr[ogatories] menconed as is supposed

To the 3 In[terrogatorie] this def[endant] sethe he dothe not knowe whether the said Bates receved any somes of money of Robt Hellme taken up by him of the rents or revennewes of the s[ai]d Erle or not nether doth this def[endant] knowe at what tyme the said Hellme did make his last accounte to the Erle or any his offycers, And further sethe as he said before in his awnswere to the first & second Interrogatories p[ar]tecallur/

To the iiijth Inter[rogatory] this def[endant] sethe that he this def[endant] did not see nor was present when the s[ai]d Hellme was arrested or imprisoned nor doth certenly knowe for what cause the s[ai]d Hellme was arrestid or imprisoned neyther doth this def[endant] knowe whether the s[ai]d Hellme was receyver to the s[ai]d Erle after his s[ai]d arrest or nott

To the vth Inter[rogatory] for [?summary?] therof as conc[er]neth the supposed obligacon menconed in the first In[terrogatory] he saith as he hath before said to the said first & second Interr[gatories] ... ... further sethe that there was a conveyance made of Acton (as this def[endant] hard) by the s[ai]d Bates to the s[ai]d Erle but for what consid[er]acon yt was made this def[endant] cannot tell neyther did this def[endant] ev[er] see the said conveyance or doth knowe any thing therein of his ownn knowledge

To the [vjth Interrogatory] he sethe that the s[ai]d Tho Bates dyed intestait & that he this def[endant] was not ... meane or p[ro]curer that the administracon of the s[ai]d Bates his goodes & chattles were praised or comitted to Isabell the wief of the s[ai]d Bates Butt this def[endant] confesseth that he this def[endant] w[i]th others became bound to thordynery uppon the adminis[tracon] comitted to the said Isabell

To the vijth he sethe that there was not any such agreem[en]t betwixt this def[endant] & the said Isabell as is menconed in the first p[ar]te of the Inter[rogatory], neyther did this def[endant] request or speake to any p[er]son or p[er]sons to appreyse the s[ai]d goodes, nevertheles this def[endant] was pryvy to the appreys[ing] of the same goodes

To the viijth Int[errogatory] this def[endant] sethe that Ro Errington one of the s[ai]d appreysers is his kinsman and further saith as he said before And that this def[endant] did not gyve or p[ro]mise any rewardes unto any of the said appreysors for appreysing of all or any of the s[ai]d goodes as is supposed

To the ixth Inter[rogatory] this def[endant] sethe that he doth thincke in his conscyence that the said goodes were preysed as they were worthe in truthe Butt this def[endant] confesseth that by the appoyntment of Mr Errington & this def[endant] .... kye were sold to other p[er]sons for the s[ai]d Mrs Bates for a higher or greater price then they were appreysed att and more he cannot say to the Int[errogatory]

To the xth In[terrogatory] this def[endant] sethe in every thing in effect as Marke Errington the other def[endant] hath before said to the same Interrogatories

To the xjth In[terrogatory] this def[endant] sethe he doth not knowe or understand of any debtes dew to the said Tho Bates at his death saving such as are sett downe in this def[endants] answere to the Cplts bill & scedule annexed therunto neyther did this def[endant] or the s[ai]d Isabell (by & w[i]th the pryvity of this def[endant]) release discharge or compound for any of the debtes due to the said Tho Bates as is supposed But this def[endant] & the s[ai]d Mr Errington sold the lease of Netherton to Robert Bates for the some of threescore & tenne poundes And further sethe as he hath before said And ..... Cannot c[er]tenly depose to the Inter[rogatory] of his owne re[mem]brance

To the xijth he sethe that this def[endant] & the s[ai]d Mr Errington or some by their dyrecon did paye all the sev[er]all somes of money sett downe in the scedule menconed in this def[endants] answere & annexed to the same to the p[er]sons therein named as debtes due to them by the s[ai]d Tho Bates And this def[endant] doth deny that he did compound w[i]th any of them for any lesser some as is supposed And further this def[endant] deposeth not to the Inter[rogatory] by cause he had not a sight of the scedule annexed to his answere or the sight of any coppy thereof at the tyme of this his exa[mination]

To the xiijth Int[errogatory] this def[endant] saith that this def[endant] & the said Mr Errington or one of them have disbursed all such p[ar]ticuler somes as are expressed in the said scedule to be disbursed about the funerall of the said Tho Bates & Isabell his wief And further this def[endant] cannot depose to the Int[errogatory] not having any p[ar]tyculer notes of any disbursem[en]ts about him att the tyme of this his exa[mination]

To the xiiijth Int[errogatory] this def[endant] deposeth to such effect in ev[er]y thing as Mr Errington the other def[endant] hath before deposed to this same Interrogatorie

To the xvth Int[errogatory] this def[endant] sethe that the s[ai]d Tho Bates did not owe any such [sums] of money to this def[endant] as is menconed in this Interr[ogatory]

To the xvjth he sethe as Mr Errington hath before said to the same Interr[ogatory]

To the xvijth Int[errogatory] he sethe he was bound to the Countesse of North[umberland] as he thincketh for Tho Bates in CCli or thereabouts for paym[en]t of one hundred & [eighteen] poundes xiijs iiijd or [thereabouts] being the due debt of the [said] Bates as this def[endant] thincketh And this def[endant] payed to Mr Sacklen & Mr Sh.... synce the death of the s[ai]d Bates lviijli xiijs iiijd or [thereabouts] of the s[ai]d debt & sume p[ar]te of the same was p[ai]d in Mr Mydeltons [?shope?] in Newecastle, & the other [part] in Newcastle And he sethe that Mark Errington was present at the paym[en]t of bothe p[ar]tes as this def[endant] thincketh & others whose names he cannot re[mem]ber

To the xviijth In[terrogatory] he sethe as Mr Errington hath before said to the same Int[errogatory]
