Rex v. Nicholas de Anecastre | Lincs | (Petition); (KB27/228 m 28) | William le Clerk de Kyme (South Kyme) petitioned king and council that Nicholas de Anecastre had defrauded him. He alleged that Nicholas had fraudulently entered into a statute merchant bond to William Payne (iuxta formam stati pro mercatoribus editi) without William Payne's knowledge and without Nicholas being indebted to William Payne. Nicholas is alleged to have added his own seal to the bond which was already sealed with the statute merchant seal. Nicholas later sold lands and tenements in Old Sleaford to William le Clerk in fee simple and put him in seisin. After the term for the repayment of the bond had passed, Nicholas went to William Paynel and bought an acquittance for the debt. He is then alleged to have obtained a certification of the unpaid debt from the London statute merchant registry. This he allegedly took to chancery to obtain a writ for his own arrest (not acted on) to put himself in seisin of the land he had sold to William le Clerk to hold until he had levied the debt because execution to levy a debt under statute merchant extended not just to lands held at the time of the execution but also to any sold or given since the date of the original bond. William le Clerk claims that he only recovered the lands by payment of another £10 to Nicholas. King's Bench is ordered to investigate. William makes a count in which he claims that Nicholas de Anecastre acknowledged the debt on 15 January 1309. He sold the land in Old Sleaford to him on 12 August 1309 and put him in seisin on the same day.
