5.  vnum mesuagium vnum columbare vnum gardinum centum acras terre viginti sex acras prati

Translation:

1.  Kent – Francis Stoughton, Henry Stoughton, Thomas Stoughton, Thomas Monynges 

2.  & William Monynges by their attorney appeared on the fourth day against Alan Mathew & Elizabeth 

3.  his wife in a plea why, whereas the same Francis, Henry [and] Thomas Stoughton, 

4.  Thomas Monynges, William, Alan & Elizabeth should hold jointly and undivided 

5.  a messuage, a dovecot, a garden, one hundred acres of land, twenty six acres of meadow 

6.  & forty acres of pasture with appurtenances in Staple & Ash next Sandwich of 

7.  the inheritance which was Richard Exherst’s, father of the aforesaid Elizabeth and also grandfather of the aforesaid 

8.  Francis Henry & Thomas Stoughton, and great grandfather of Thomas Monynges & William 

9.  Monynges, whose heirs they are according to the custom of gavelkind in the county aforesaid, 

10. the same Alan and Elizabeth oppose the making of a partition thereof among them according to the law & custom 

11. aforesaid & do not permit it to be made, without justice etc. And they do not 

12. come. And it was ordered to the sheriff that he attach them etc. and the sheriff now sends that they were attached 

13. by pledge of John Den’ & Richard Fen’ Therefore they are in mercy and are to be distrained that they be here 

14. in the Quindene of Easter etc.
